General conditions of consultation and use of the photo library of the Pyrénées Méditerranée intercommunal Tourist Office and the Community of Communes Albères Côte Vermeille Illibéris

1. Presentation

The Photo Library (hereinafter “the Photo Library”), published for the Pyrénées Méditerranée intercommunal Tourist Office, a public industrial and commercial establishment, and the Communauté de Communes Albères Côte Vermeille Illibéris, a local authority, is a bank of documents on the themes of the intercommunal destination Pyrénées Méditerranée and the Community of Communes Albères Côte Vermeille Illibéris – tourism, entertainment, territory, population. The headquarters of these two structures is Impasse Charlemagne in 66700 Argelès-sur-Mer, France. The telephone number of the Pyrénées Méditerranée intercommunal Tourist Office is 0448980008 and that of the Communauté de Communes Albères Côte Vermeille Illibéris is 0468816377 .

The Photo Library is intended to promote themes linked to the Pyrénées Méditerranée destination and those linked to the Community of Communes Albères Côte Vermeille Illibéris via consultation of the Photo Library and by allowing them to download images from the Photo Library.

The consultation is open to any person visiting the Photo Library website (hereinafter “the Site”). Downloading documents from the Photo Library (hereinafter “the Documents”) is reserved for certain categories of users with an access code and password provided in advance by the Pyrénées Méditerranée Intercommunal Tourist Office and/or the Community of Communes Albères Côte Vermeille Illibéris.

These general conditions (hereinafter “CGU”) are intended to govern the conditions under which users can consult and/or download the Documents.

2. Acceptance and modification of the T&Cs

2.1 Acceptance of the T&Cs:

Access and use of the Photo Library automatically implies acceptance of the T&Cs. Only recognition and acceptance of the T&Cs will allow access and downloading of the Documents.

The General Terms and Conditions supplement the legal notices of the Site which users can access on the home page of the Site. Access and use of the Site also automatically implies acceptance of the legal notices.

Acceptance of the T&Cs by a natural person falling into the category of “user” access, defined in Article 3 below, is deemed to have been made in the name of the legal entity to which they belong (unless the user is an independent ) and thus constitutes acceptance of the T&Cs by the said legal entity

2.2 Modification of the T&Cs:

The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris reserve the right at any time, without notice, with or without warning, to modify the T&Cs. Any modification of the T&Cs commits and implies the acceptance of users with immediate effect. It is up to users to regularly consult the Site to keep up to date with the terms and conditions in force.

3. Conditions of access to the Photo Library

There are 2 levels of user access to the Photo Library:

Level 1: Access to photos from all photographers

  • PR agency (HD download + direct link sending)
  • Press (HD download)

Level 2: Access to photos by photographers from the Pyrénées Méditerranée intercommunal Tourist Office and the Albères Côte Vermeille Illibéris Community of Communes

  • Partners (download request only on a particular selection)
  • Service providers (access to a resources folder + HD download on specific selection)
  • Pros (access to a resources folder + HD download on specific selection)
  • TO / Travel agencies (HD download on special selection)
  • Other (download request on specific selection)

Access to and downloading of the Documents is free.

4. Authorized framework for using the Photo Library

Access and the right to use the Photo Library are granted for the sole purposes defined herein, namely for the purposes of information, communication and promotion of tourism and the image of the destination Pyrénées Méditerranée, Albères Côte Vermeille Illiberize according to the level of access each user has.

Any commercial or advertising use of the Documents or any use for purposes other than those referred to above is strictly prohibited.

5. Intellectual property rights

The Documents constitute intellectual works protected under intellectual property law.

The Documents are the property of the Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris or of third parties having authorized the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris to use and/or exploit.

In accordance with the intellectual property code, any representation, reproduction, modification, denaturation, total or partial, of all or part of the Documents, by any process whatsoever and on any medium whatsoever, not expressly authorized by the Office of Intercommunal tourism Pyrénées Méditerranée and/or the Community of Communes Albères Côte Vermeille Illibéris under these T&Cs or non-compliance with these T&Cs is prohibited. Such uses (i) would constitute acts of infringement of copyright and/or distinctive sign law and would incur the criminal and civil liability of users on this basis and (ii) would authorize the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris to exercise all the rights and prerogatives conferred on it to pursue these acts.

Any compilation or creation of derivative works from the Documents is also prohibited.

6. Rules applicable to uploading documents for level 1 and 2 users

The provisions of this article 6. Apply only to users falling into the category of levels 1 and 2, namely people with the right to download the Documents.

6.1 Right of access to download and right of withdrawal

Access to downloading Documents is individualized and secure, with the Pyrénées Méditerranée Intercommunal Tourist Office and/or the Albères Côte Vermeille Illibéris Community of Communes providing users with an access code and password.

Access codes and passwords are confidential, personal, non-transferable and non-transferable. Each user is responsible for their management, conservation and the consequences of their use. It is up to each user to take the necessary precautions for their conservation and protection. The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris cannot under any circumstances be held responsible for any fraudulent use of these access codes and passwords.

Furthermore, each user undertakes to immediately inform the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris of any possible unauthorized use relating to their access to the Photo Library.

Each user acknowledges and accepts that the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris reserves the right, with or without warning and without notice:

  • to cancel or close individualized access in the event of a user's failure to comply with these T&Cs;
  • to temporarily or permanently close individualized access for security conditions not respected or in the event of a violation of the T&Cs by a user.

6.2 Conditions related to reproduction rights and representation of Documents

Rights granted:

The Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris declare that they have the rights, in their capacity as author or assignee of said rights, and have obtained authorization for the models appearing on the Documents, allowing the downloading and use of the Documents to be offered under the conditions set out below.

The Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris grant the user a free, non-exclusive, personal, non-transferable and non-sublicensable right to reproduce and represent each document. downloaded, and only within the limits specified below.

The reproduction and representation use of documents is strictly limited to:

  • a use defined in article 4 of the T&Cs.
  • the period indicated on each downloaded document
  • France and its territories. By exception, the reproduction and representation of Documents on internet and extranet sites are granted for all countries in the world.
  • Single use. Once the document has been reproduced and represented, any subsequent use of the same document will require a new download. Users therefore undertake to delete the file on which they have downloaded the document after its reproduction and representation.

The granting of these reproduction and representation rights does not entail any transfer of ownership or copyright for the benefit of users.

Any reproduction or representation of the Documents must include in a legible manner the copyright notices (rights of the Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris and/or those of its licensors) present on Documents to download.

Users may not under any circumstances alter, modify, hide or remove the notices present on the Documents.

In the event of omission of these mentions on the Documents, the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris may order the user to add them and in the event of non-reestablishment of the mentions in the most promptly, cease the use of said Documents.

6.3 Restrictions

The Documents may be cropped, provided that their integrity is not compromised, but must in no case be rotated, modified or altered, whether manually or electronically, without the explicit written authorization of the Pyrénées Intercommunal Tourist Office Mediterranean and/or the Community of Communes Albères Côte Vermeille Illibéris.

Prohibited are (i) any compilation or creation of Derivative Works from the Documents, (ii) any integration of the Documents into a logo, trademark or service mark.

Any use of the Documents for commercial purposes is strictly prohibited.

Users may not make the Materials available to third parties for the purpose of authorizing or inviting others to download or check out the Materials.

6.4 Right to verify uses of Documents

The Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris will be entitled to ask users to provide them with a copy of the reproductions and representations of the Documents in order to verify compliance of the uses with these T&Cs. Users will have twenty-one (21) working days to provide the Pyrénées Méditerranée intercommunal Tourist Office and/or the Albères Côte Vermeille Illibéris Community of Communes with said copies.

7. User Responsibilities

Users undertake to reproduce and represent the Documents under the conditions defined in article 6.2 of the T&Cs.

By accepting it, the user is prohibited from any type of use not explicitly provided for by law or not expressly authorized by the T&Cs. Level 1 and 2 users assume responsibility for the suitability of the Materials to their particular needs. They are the sole and exclusive responsible for the use of the Documents. Users must, in particular, examine the Documents to detect possible defects (digital or otherwise) before reproducing them. In the event of detection of such defects, they will notify the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris who will make their best efforts to remedy the situation.

The use of the Documents for illicit purposes is strictly prohibited, whether directly or indirectly (by context or by juxtaposition) linked to a specific subject.

Users must immediately notify the Pyrénées Méditerranée intercommunal Tourist Office and/or the Communauté de Communes Albères Côte Vermeille Illibéris if they are aware or suspect that a third party, who has had access to the Documents, is using all or part of them fraudulently. Documents or violates any intellectual property rights of the Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris or third parties having granted licenses to it.

8. Responsibilities of the Pyrénées Méditerranée intercommunal Tourist Office and the Community of Communes Albères Côte Vermeille Illibéris

The Pyrénées Méditerranée intercommunal Tourist Office and the Community of Communes Albères Côte Vermeille Illibéris will make their best efforts to ensure the continued accessibility and proper functioning of the Photo Library.

The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris cannot, however, guarantee that the operation of the Photo Library will be uninterrupted OR continuous and free from any error and cannot be held responsible in the event of unavailability of the Photo Library. , for whatever reason.

The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris cannot under any circumstances be held responsible for indirect material damage and direct and indirect immaterial damage resulting from a supposed or real defect in the documents or, any way, of their reproduction. By indirect damage we mean in particular: missed profit, financial damage, loss of customers, loss of turnover or profit, loss of brand image, inaccuracy, corruption or loss of files, data or computer programs any. Any action taken against users by a third party is considered indirect damage, and therefore does not give rise to the right to compensation.

In any event, the Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris cannot be held responsible in the event of use by a user of the Photo Library that does not comply with these T&Cs.

Likewise, the Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris cannot be held responsible for facts due to an event of force majeure, breakdowns and technical problems concerning equipment, programs and software or the Internet network which may, where applicable, lead to the suspension or cessation of the Photo Library.

The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris reserve the right at any time, without notice, with or without warning the possibility of modifying, suspending or interrupting the distribution of all or part of the content of the Photo library.

The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris guarantee to users that the use by users of the Documents in their original form and in accordance with these T&Cs will not infringe any copyright or moral rights of any natural or legal person.

9. Applicable law and competent jurisdiction

The T&Cs are governed by French law. Any use made of it must be done under conditions respecting the law and will be deemed to have taken place on French territory.

10. In the event of a dispute relating to the interpretation, validity and consequences of the T&Cs and, in the absence of a prior amicable solution, the courts of Perpignan will have sole jurisdiction.

The Pyrénées Méditerranée intercommunal Tourist Office and the Communauté de Communes Albères Côte Vermeille Illibéris reserve the right to take legal action against people acting in a manner that could be considered illegal or illicit or contravening these conditions.
